This is a sincere question. I had a great time on the Dragon last weekend (July 29/30). Everybody I saw was polite, riding safely within their limits and having a great time. The Miata people were considerate, nice and friendly. Didn't see a single LEO the whole time. It was a wonderful experience and I want to come back ASAP.

The thought struck me: how would a LEO ticket someone on the Dragon, anyway? If he sets up stationary, every rider will warn all oncoming riders. If he uses moving instant-on radar, he can't easily turn around and give chase. It's hard enough to turn a bike around, much less a car.

If he radios to a pick up man, how does he identify the oncoming bike? It's not like "get the red corvette". Oncoming bikes on the Dragon are often visible for about 2 sec, and bikes aren't as identifiable as cars. "Speeding sport bike, it's, ah, maybe blueish, rider has black leather suit". That narrows it down to about 1/3 the bikes there. Even dedicated bike fans often have difficulty identifying an oncoming bike at the interception angles and timing involved on the Dragon. Just curious how it could possibly work.

Well their are a few locations they can set up radar if they wish, most of the time we are left alone until their is an accident then they come out and monitor to make sure we have not lost our mind. TN HP and Blunt County have been great to work with this year.

Further, for instance, Knoxville motor officers practice here. So do some other LEO. So, someone might come in here expecting to spank a local, professional rider. I'm not bettin' on it, dudes... not even 2 cents...

Thanks, that's what I observed my first time there. I was surprised at how mature and well-behaved the riders were, in spite of no apparent LEO presence whatsoever.

Rockford PD in Blount County murdered a biker, rather than than bother with a traffic stop. Man charged after trooper struck

A 22-year-old Maryville man has been charged with aggravated assault after he allegedly struck a Tennessee Highway Patrol trooper with his motorcycle, then fled the scene on the Dragon.

Trooper Brent Cagle was investigating a fatal motorcycle accident between Mile Markers 5 and 6 on the Dragon Tuesday when he was injured by another motorcyclist.

Cagle said he was still at the scene of a 1:27 p.m. crash that killed a Florida law enforcement officer when he heard the whine of a motorcycle engine coming down the mountain rapidly. He said he stopped what he was doing and watched for the fast-moving vehicle to reach the accident scene.

According to Cagle's report, the motorcycle rounded the curve traveling well over the posted speed limit of 30 miles per hour. Cagle said he stepped out into the center of the roadway and held out his hands signaling the motorcycle to stop. The motorcycle came to a halt in the lane where he had been traveling and Cagle said he told the driver to pull over to the shoulder on the opposite side of the twisting two-lane road.

``There was no shoulder on the right side,'' Cagle said. ``That's where the other motorcycle had gone off.''

The trooper said the man, operating the Kawasaki Ninja ZX6R, moved a few feet forward and to the left, stopping in the on-coming traffic lane. Cagle said he again told the man to pull off on the shoulder but the man raised the face mask on his helmet and asked, ``Am I in trouble?''

Cagle said he instructed the man for the third time to move to the shoulder ``Now!'' Cagle said he was concerned that a vehicle traveling up the mountain would round the curve and be unable to stop before striking both the stopped motorcycle and the trooper standing on the pavement.

Instead of obeying the order to move to the shoulder, Cagle said the motorcyclist turned his wheel to the right, as though he was starting a U-turn to head back up the mountain and across the state line in to North Carolina. The trooper ran toward the motorcycle and, instead of completing the turn, he said the driver straightened his handle bars and drove at the trooper who was then six or seven feet away from the motorcycle.

Cagle tried to sidestep and grab the man on the motorcycle, but the impact near the center of his body knocked him backward and off the ground. He hit the pavement on his left shoulder and the left side of his face as the motorcycle sped away.

Cagle said he was unable to pursue the fleeing man due to the traffic fatality investigation he needed to complete. It appeared the motorcyclist had gotten away.

On Wednesday, Cagle said he is glad that most law enforcement vehicle's including those used by the Tennessee Highway Patrol are now equipped with video cameras. He said cameras provide documentation and clues that often lead to an arrest.

On Thursday, Cagle traced the temporary tag on the motorcycle that left the scene by using the dates on the tag and the type of motorcycle displaying the tag. Cagle checked the Tennessee driver's license photo on file for the person to whom the temporary tag was issued and confirmed the identity of the motorcyclist.

Cagle said he planned to try to locate Daniel Thomas Elson Jr., 21, of Morganton Road, Maryville, on Friday. However, as he left the Maryville THP office Thursday afternoon, he recognized the motorcycle and its operator coming down Home Avenue. He made a traffic stop and took Elson into custody.

Elson was booked at the Blount County Jail on a charge of aggravated assault at 6:30 p.m. Friday. Cagle also issued citations charging him with reckless driving and misdemeanor fleeing to avoid arrest. Elson is free on a $1,000 bond pending a 1:30 p.m. Aug. 24 appearance in Blount County General Sessions Court.

"Necessity" is a valid legal defense under Tennessee Rules of Criminal Procedure and Civil Procedure. The copster standing in the middle of the road was clearly "acting under color of law" (illegally), and was perpetrating the crime of suicidal behavior, by standing in the middle of a busy public highway. The correct action was to place "warning cones" around blind corners, to warn approaching traffic of the crash, but copsters never do this. The hand signal to pull over was clearly an illegal order. No person is ever required to follow an illegal order. Then the copster confessed to physically assaulting the motorist, which is a crime subjecting the copster to arrest.

All "traffic stops" can be lawfully ignored using the necessity defense, as proven on all the "Amazing Videos" shows on Tee Vee, showing parked cars smashed during "routine traffic stops". Drivers drive where they look, so when they see the flashing lights of a Police State Death Squad parked on the busy highway, they naturally drive right into the left rear quarter panel of the copster's car, knocking it into the defendant's parked vehicle. In Tennessee, it is a crime to park on the shoulder of any public street or highway, and 1,000s of vehicles are stolen by the Police State and their mafia towing contractors misusing this law. So it is unlawful for a copster to give an order to do something that is both dangerous and unlawful. It is a violation of Constitutional Equal Protection doctrine, for copsters to be allowed the right to park on a public highway (stalking motorists), but non-government employees are not.

The videotape from the copster's vehicle will prove the copster perped dozens of criminal misdemeanors and felonies, during the single day relevant to this event. Constitutional Equal Protection doctrine orders that when a government employee is granted a right to do something, such as exceed the speed limit without using emergency lights and siren turned on, then all persons are granted that same right.

The posted speed limit on US129 is 30mph in TN. This is an unlawful and illegal speed limit, since it's not based on the required "traffic engineering survey", which would be filed in the Blount County DOT office, if it existed.

Note that if this rider had simply ignored the trooper, and not slowed down, and not stopped, and not spoken to the trooper, there would have been no problem.

If the biker had stopped and signed the citation using UCC signature, as shown above, then that citation would be voided under duress. No argument, no begging, no lying required. All future signatures by this defendant should be signed that same way. The TN General Sessions judge always asks, "Are you voluntarily waiving your right to..?", which is a hint that signing "under duress" or "under protest" defeats the "personal jurisdiction" of the court.

Thank God, The Dragon finally ate a copster. DEAD. I wonder how many 1,000s of armed robberies, carjackings and kidnappings that copster had perped against US citizens, during his career in a Police State Death Squad? Looks like it's time for bikers to volunteer for jury duty in Blount County. "Jury Nullification" allows any juror to veto any law, since TN Pattern Jury Instructions order that all jurors must "judge both the facts and the law", as upheld by US Supreme Court.

Big Brother will be watching you for sure by 2008 -- the year a proposed requirement that Event Data Recorders (EDRs) become mandatory standard equipment in all new cars and trucks will become law unless public outrage puts the kibosh on it somehow.

EDRs are "black boxes" -- just like airplanes have. They can record a wide variety of things -- including how fast you drive and whether you "buckle-up for safety." The National Highway Traffic Safety Administration (NHTSA) wants EDRs to be installed in every new vehicle beginning with model year 2008 -- on the theory that the information will help crash investigators more accurately determine the hows and whys of accidents.

But EDRs could -- and likely will be -- used for other purposes as well.

Tied into GPS navigation computers, EDRs could give interested parties the ability to take automated ticketing to the next level. Since the data recorders can continuously monitor most of the operating parameters of a vehicle as it travels -- and the GPS unit can precisely locate the vehicle in "real time," wherever it happens to be at any given moment -- any and all incidents of "speeding" could be immediately detected and a piece of paying paper issued to the offender faster than he could tap the brake. That's even if he knew he was in the crosshairs, which of course he wouldn't. Probably they'll just erect an electronic debiting system of some sort that ties directly into your checking account -- since the paperwork could not keep up with the massive uptick in fines that would be generated.

If you think this is just a dark-minded paranoiac vision, think again. Rental car companies have already deployed a very similar system of onboard electronic monitoring to identify customers who dare to drive faster than the posted limit -- and automatically tap them with a "surcharge" for their scofflaw ways. While this inventive form of "revenue enhancement" was challenged and subsequently batted down by the courts, the technology continues to be honed -- and quietly put into service.

Already, 15-20 percent of all the cars and trucks in service have EDRs; most of these are General Motors vehicles. GM has been installing "black boxes" in its new cars and trucks since about 1996 as part of the Supplemental Restraint (air bag) system. Within a few years, as many as 90 percent of all new motor vehicles will be equipped with EDRs, according to government estimates -- whether the requirement NHTSA is pushing actually becomes law or not.

The automakers are just as eager to keep tabs on us as the government -- in part to keep the lawyers who have been so successfully digging into their deep pockets at bay. EDRs would provide irrefutable evidence of high-speed driving, for example -- or make it impossible for a person injured in a crash to deny he wasn't wearing a seat belt.

Insurance companies will launch "safety" campaigns urging that "we use available technology" to identify "unsafe" drivers -- and who will be able to argue against that? Everyone knows that speeding is against the law -- and if you aren't breaking the law, what have you got to worry about?

It's all for our own good.

Driver in van crash to be deported

CHATTANOOGA, Tenn. — An illegal immigrant who drove a van into a house, striking a 91-year-old woman who later died, will be deported, despite a request from the victim's relatives that the driver be allowed to "become a contributing member of society," a prosecutor said.

Hamilton County Assistant District Attorney Jay Woods, acting at the request of the accident victim's family, agreed to a sentence of probation for Vitalina Bautista-Vargas as part of a plea agreement that a judge approved Monday. He said federal immigration officials intervened and want the woman deported to Guatemala.

With the aid of an interpreter, Bautista-Vargas, 30, pleaded guilty Monday to vehicular homicide and leaving the scene of the June 27 accident. A van driven by Bautista-Vargas careened into the house of 91-year-old Lovella Winton on June 27. Winton was sleeping when the van crashed through her bedroom wall. She died days later at a hospital. Woods said Bautista-Vargas was driving 'at a high rate of speed and without experience.'

The driver's husband, who also does not speak English, was in court Monday and occasionally wiped away tears as the judge discussed the prospect that his wife would be deported.

Family may sue troopers in dog shooting

COOKEVILLE, Tenn. — A family whose dog was shot during a 2003 during a traffic stop can sue Tennessee Highway Patrol troopers for excessive force but not for violating their civil rights, a federal appeals court ruled Friday.
A patrol car video of the January 2003 shooting after the Smoak family of North Carolina was wrongly identified as being involved in a robbery was widely shown on television.

While the family was ordered by officers to kneel on the highway shoulder, their dog Patton escaped from the vehicle through an open door that the family had repeatedly asked the officers to close.

Cookeville police officer Eric Hall shot the 55-pound mixed breed pit bull, which could be seen wagging its tail in the video. Hall said he thought the dog was about to attack.
